Terms of Service

Quick Summary: By using ForgedRider, you agree to ride safely, submit truthful ride data, pay
for certifications when required, and acknowledge that we verify rides but cannot guarantee absolute safety.
You're responsible for your own riding decisions. These terms are legally binding.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your")
and ForgedRider ("we," "us," or "our") governing your use of the ForgedRider mobile application and related
services (collectively, the "Service").
By creating an account, downloading, or using ForgedRider, you acknowledge that you have read,
understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Eligibility
To use ForgedRider, you must:
- Be at least 16 years of age
- Hold a valid motorcycle license or permit in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
By using ForgedRider, you represent and warrant that you meet these eligibility requirements.
3. Service Description
ForgedRider provides GPS-verified motorcycle endurance ride certification. Our Service includes:
- GPS Ride Tracking: Real-time GPS tracking of your motorcycle rides
- Ride Verification: Automated verification of ride distance and duration
- Digital Certifications: Instant digital certificates upon successful ride completion
- Physical Patches: Embroidered patches shipped to verified riders
- Achievement System: Progressive tier system (Apprentice, Journeyman, Master, Legend)
- Leaderboards & Challenges: Optional participation in competitive events
4. Account Registration
4.1 Account Creation
To use ForgedRider, you must create an account by providing:
- Valid email address and phone number
- Full legal name (as you want it to appear on certifications)
- Password meeting our security requirements
- Optional: Motorcycle make, model, year, years riding, and riding preferences
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information is accurate and current
4.3 One Account Per Person
You may only create one account per person. Creating multiple accounts to gain unfair advantage (e.g., claiming
multiple certifications for the same ride) is prohibited and may result in permanent ban.
5. Ride Tracking and Certification
5.1 GPS Tracking Requirements
To receive certification, you must:
- Enable location permissions throughout your ride
- Keep the app active during the entire ride
- Maintain a stable GPS signal (avoid extended tunnels or GPS-blocked areas)
- Complete the ride distance under the challenge duration within a continuous time period.
5.2 Certification Criteria
We verify rides based on:
- Distance: Your ride is verified against the challenge distance you selected (e.g., if you
set a challenge for 538 miles, you must complete at least 538 miles)
- Duration: Time is measured continuously from start to finish. Multi-day rides are expected
and breaks for rest, fuel, and meals are normal, but the total elapsed time is tracked
- Speed Validation: Realistic motorcycle speeds (GPS anomalies flagged)
Note: Achievement tiers (Apprentice, Journeyman, Master, Legend) are based on the number of
certified rides you complete, not fixed distance requirements.
5.3 Truthful Submission
You agree to:
- Submit only genuine motorcycle rides you personally completed
- Not manipulate GPS data or attempt to deceive the system
- Not use vehicles other than motorcycles for certification rides
- Not manipulate photos or photo metadata
- Provide accurate odometer readings at start and finish
- Provide accurate information about your ride conditions
5.4 Verification Process
All rides undergo automated verification. We reserve the right to:
- Manually review suspicious rides
- Request additional evidence (photos of receipts)
- Reject rides that do not meet our standards
- Revoke certifications issued in error or through fraud
IMPORTANT: ForgedRider certification is for personal achievement recognition. It does not
confer any legal rights, insurance benefits, or professional credentials. Certifications are not recognized by
official government or insurance bodies unless they specifically state otherwise.
6. Payment and Fees
6.1 Pricing
Current pricing (subject to change with 30 days notice):
- Certification Fee: $65 USD per ride certification (includes digital + physical patch)
- Additional Patches: $20 USD per replacement or extra patch
- Merchandise: Varies by item (t-shirts, stickers, etc.)
6.2 Payment Processing
- All payments are processed securely through Stripe
- We accept major credit/debit cards through Stripe
- Prices displayed in USD; currency conversion may apply
- You authorize us to charge your payment method upon purchase
6.3 Taxes
- Prices do not include applicable sales tax, VAT, or GST
- Taxes calculated at checkout based on your location
- You are responsible for paying all applicable taxes
6.4 No Refunds (Except as Required by Law)
Due to the immediate digital certification and custom physical patch production:
- Digital certifications: Non-refundable once issued
- Physical patches: Non-refundable once production begins (typically within 24 hours)
- Merchandise: See our Refund Policy below
Exceptions: Refunds provided if we fail to deliver the service or product, or if required by
consumer protection laws in your jurisdiction.
7. Intellectual Property
7.1 Our Property
ForgedRider owns all rights to:
- The ForgedRider name, logo, and branding
- App design, code, and functionality
- Patch designs and certification templates
- All content created by ForgedRider
7.2 Your Content
You retain ownership of content you upload (photos, ride descriptions). However, by uploading content, you grant
ForgedRider a:
- Non-exclusive, worldwide, royalty-free license
- To use, display, and process your content for Service operation
- To showcase your achievements (with your permission) in marketing
- To verify ride authenticity and prevent fraud
You can revoke this license by deleting your content or account.
7.3 Prohibited Use
You may not:
- Copy, modify, or reverse engineer any part of ForgedRider
- Use ForgedRider branding without written permission
- Create derivative works or competing services based on ForgedRider
- Scrape or automatically collect data from the Service
8. User Conduct
You agree NOT to:
- Violate Laws: Use the Service for any illegal purpose
- Fraud: Submit false, misleading, or manipulated ride data
- Abuse System: Exploit bugs, glitches, or loopholes
- Harassment: Abuse, threaten, or harass other riders or staff
- Spam: Send unsolicited messages or promotional content
- Impersonation: Pretend to be another person or entity
- Hacking: Attempt to access unauthorized areas of the Service
- Malicious Code: Upload viruses, malware, or harmful code
Violation may result in immediate account suspension or termination.
9. Safety and Liability
Note: By creating a ForgedRider account, you have signed our Participant Agreement which
includes a comprehensive liability waiver, assumption of risk, and release of liability. The terms below
supplement that signed agreement.
⚠️ CRITICAL SAFETY NOTICE
Motorcycle riding is inherently dangerous. ForgedRider does NOT guarantee your safety.
You acknowledge and accept that:
- Endurance motorcycle rides carry significant risk of injury or death
- You are solely responsible for your safety and riding decisions
- ForgedRider certification does not imply competence or safety endorsement
- You must follow all traffic laws and ride within your skill level
- Weather, fatigue, and road conditions are your responsibility to assess
9.1 No Liability for Riding Incidents
To the maximum extent permitted by law, ForgedRider is NOT liable for:
- Any accidents, injuries, or death occurring during rides
- Any property damage to your motorcycle or other vehicles occurring during rides
- Any traffic violations or fines you incur during rides
- Decisions you make based on the app's features (route suggestions, challenges, etc.) during rides
- GPS inaccuracies or app malfunctions during rides
9.2 App Functionality
ForgedRider is provided "AS IS" without warranties. We are NOT liable for:
- App crashes, bugs, or data loss during rides
- GPS signal loss or tracking errors during rides
- Delayed or incorrect certifications post rides
- Server downtime or service interruptions during rides
- Battery drain or device performance issues during rides
9.3 Third-Party Services
We are not responsible for:
- Stripe payment processing issues (see Stripe's terms)
- Shipping delays or lost merchandise (carrier responsibility)
- Third-party websites or services linked from our app
9.4 Limitation of Liability
In no event shall ForgedRider's total liability exceed the amount you paid ForgedRider in the past 12
months.
This limitation applies to all claims, including but not limited to: negligence, breach of contract, property
damage, personal injury, or any other legal theory.
9.5 Indemnification
You agree to indemnify and hold harmless ForgedRider and its owners, officers, directors, employees, contractors,
agents, affiliates, successors, and assigns (collectively, "ForgedRider Parties") from any claims, losses,
damages, or expenses (including
legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your riding activities tracked through ForgedRider
- Your violation of any laws or third-party rights
10. Termination
10.1 Your Right to Terminate
You may request account deletion at any time by emailing info@forgedrider.com. We will process deletion requests within 30
days and retain data only as required by law.
10.2 Our Right to Terminate
We reserve the right to suspend, terminate, or refuse service to any account at any time, with or without notice,
for any reason, including but not limited to:
- Violation of these Terms or our policies
- Submission of fraudulent, false, or manipulated ride data
- Abuse, harassment, or threatening behavior toward other riders or staff
- Failure to pay fees owed or multiple failed payment attempts
- Engagement in illegal activities or use of the Service for unlawful purposes
- Creation of multiple accounts or circumventing previous bans
- Attempts to reverse engineer, hack, or compromise the Service
- Suspicious activity that suggests fraud or system manipulation
- Inactivity for extended periods (we may delete dormant accounts after 3+ years)
- Conduct that violates the spirit of fair competition and honest achievement
- Risk to the security, integrity, or operation of the Service
- At our sole discretion if we determine the relationship is no longer viable
Termination decisions are final and not subject to appeal, except as required by law.
10.3 Effect of Termination
Upon termination:
- You lose access to your account and features
- Previously issued certifications remain valid (we don't revoke legitimate achievements)
- No refunds for unused certifications or prepaid merchandise
- We may retain data as required by law or for fraud prevention
11. Modifications to Service and Terms
11.1 Service Changes
We reserve the right to:
- Modify or discontinue features at any time
- Change pricing with 30 days notice
- Update certification requirements
11.2 Terms Updates
We may update these Terms from time to time. For significant changes, we will notify you via email or in-app
notice at least 14 days before the changes take effect. Minor changes (such as typo corrections or
clarifications that do not affect your rights) may be made without prior notice.
The "Last Updated" date at the top of this page will always reflect the most recent revision. Continued use of
the Service after changes take effect constitutes your acceptance of the updated Terms.
12. Dispute Resolution
12.1 Governing Law and Jurisdiction
These Terms are governed by the laws of Ontario, Canada. You agree that any legal action or proceeding must be
brought exclusively in the courts of Ontario, and you consent to the jurisdiction of those courts.
12.2 No Class Actions
You agree to resolve any disputes with ForgedRider on an individual basis only. You waive any right to
participate in class action lawsuits, class arbitrations, or any collective legal action against ForgedRider.
12.3 Informal Resolution Required
Before filing any legal claim, you must first contact us at info@forgedrider.com and give us at least 30 days to resolve the
issue. Most problems can be worked out through direct communication.
12.4 Limitation Period
Any claim against ForgedRider must be filed within one (1) year of the date the issue arose. After one year, the
claim is permanently barred.
13. Miscellaneous
13.1 Entire Agreement
These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and
ForgedRider.
13.2 Severability
If any provision is found invalid, the remaining provisions remain in full effect.
13.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
13.4 Assignment
You may not transfer your account or these Terms. We may assign our rights to a successor entity.
13.5 Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control (natural
disasters, pandemics, government actions, etc.).

15. Refund Policy
Certification Fees
- Non-refundable once digital certificate is issued (instant upon ride approval)
- Non-refundable once physical patch production begins (within 24 hours)
- Refundable if we fail to deliver certification or patch due to our error
- Refundable if ride is rejected due to app malfunction (verified by our team)
Physical Merchandise
- Returns accepted within 30 days if unused and in original condition
- Shipping costs not refundable
- Return shipping paid by customer (unless item defective)
- Refund issued within 10 business days of receiving returned item
Defective Products
- Report defects within 10 days of receipt
- Provide photos of defect
- We'll replace or refund at no cost to you (including shipping)
Shipping Issues
- Lost in mail: Full refund or replacement after carrier confirms loss
- Wrong address: No refund if you provided incorrect shipping info
- Stolen packages: Not our responsibility (file police report and claim with carrier)
How to Request Refund
- Email info@forgedrider.com within 30 days
- Include: Order number, reason, and photos (if applicable)
- We'll respond within 3 business days
- Refunds processed within 10 business days of approval
Regional Refund Rights
If you're in the EU, UK, Australia, or other regions with consumer protection laws, you may have additional
refund rights beyond this policy. Contact us to exercise those rights.
